2. Intellectual Property and Document Ownership

Your Documents: You retain complete, unrestricted ownership and all intellectual property rights in the documents, images, and PDF files you process using our tools. Because Edit Scanned PDF operates as a client-side web application executing locally inside your web browser sandbox, we do not claim any copyright, license, ownership, or title over your uploaded or generated content.

Our Platform: Unless otherwise indicated, the website itself, including all underlying source code, user interface layouts, software algorithms, graphics, icons, branding, and text, is our proprietary property or licensed to us, and is protected under international copyright, trademark, and unfair competition laws.

3. Acceptable Use Policy & Anti-Fraud Rules

Users may only upload and edit documents they own or have legal authorization to modify. Using this service to alter documents for fraud, identity theft, tax evasion, misrepresentation, or any illegal purpose is strictly prohibited.

You agree to use our website and tools strictly for lawful, legitimate, and authorized purposes. You explicitly warrant and represent that you will NOT:

• Use this service to alter, forge, fabricate, or falsify documents for fraudulent, deceptive, or illegal purposes—including but not limited to government-issued identity cards, passports, driver's licenses, academic certificates/diplomas, court records, tax forms, or banking statements.
• Upload, process, or modify documents that you do not legally own or have explicit legal authorization from the lawful owner or issuing authority to edit.
• Attempt to bypass, disable, or interfere with security-related features, integrity checks, or access restrictions of the website, web servers, or hosting infrastructure.
• Use automated scripts, bots, spiders, scrapers, or programmatic requests to overwhelm, degrade, or disrupt the performance of our web servers.
• Engage in any activity that violates any applicable local, municipal, state, national, or international statute, ordinance, rule, or regulation.

4. Local In-Browser Processing & Service Availability

Edit Scanned PDF is provided as a client-side, browser-executed utility leveraging HTML5 Canvas, WebAssembly (Wasm), and local JavaScript parsing engines. While we make every technical effort to ensure broad cross-platform compatibility across modern desktop and mobile browsers (Google Chrome, Mozilla Firefox, Apple Safari, Microsoft Edge), we do not warrant uninterrupted, error-free, or lossless execution on every hardware configuration.

Optical Character Recognition (OCR) accuracy and layout rendering fidelity may vary depending on font complexity, resolution, scan skew, lighting, and compression parameters of the input file. Users are advised to thoroughly inspect all exported documents prior to official or commercial submission.

5. Statutory Intermediary Status & Section 79 Safe Harbor (IT Act, 2000)

Edit Scanned PDF functions strictly as a technology platform and digital intermediary within the meaning of Section 2(1)(w) and Section 79 of the Information Technology Act, 2000 (India), as amended, read alongside the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Under statutory safe harbor provisions:

• Edit Scanned PDF does not initiate the transmission, select the receiver of any transmission, or select or modify the information contained in any user-processed transmission. All computational operations occur locally in the user's browser runtime.
• In compliance with Rule 3(1)(b) of the Intermediary Rules, 2021, users are hereby informed and notified that they must not host, display, upload, modify, publish, transmit, store, update, or share any information that:
  • Belongs to another person and to which the user has no lawful right or authorization;
  • Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, insulting or harassing on the basis of gender, or racially/ethnically objectionable;
  • Infringes any patent, trademark, copyright, or other proprietary rights;
  • Deceives or misleads the addressee about the origin of the message or knowingly communicates false or misleading information;
  • Impersonates another person or constitutes criminal forgery or identity theft under the Bharatiya Nyaya Sanhita, 2023 (BNS) or Information Technology Act, 2000;
  • Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign States, or public order.
• Edit Scanned PDF exercises statutory due diligence and reserves the immediate right to terminate access, block abusive IP addresses, or cooperate fully with law enforcement authorities upon receipt of actual knowledge or lawful court orders regarding illicit usage.

6. Comprehensive User Indemnification Clause

You agree to defend, indemnify, and hold harmless Edit Scanned PDF, its founders, owners, operators, developers, affiliates, licensors, service providers, and agents from and against any and all claims, actions, suits, demands, damages, liabilities, obligations, losses, settlements, judgments, penalties, fines, costs, or expenses (including reasonable attorneys' fees and litigation expenses) arising out of or directly or indirectly related to:

• Your access to, use of, or inability to use the website, tools, or utilities;
• Any document, file, text, image, signature, or graphic processed, altered, generated, or exported by you through our platform;
• Your violation of any provision of these Terms of Service, Acceptable Use Policy, or Privacy Policy;
• Your violation of any third-party right, including but not limited to any copyright, trademark, trade secret, privacy, publicity, or contractual right;
• Any claim that your modified document caused financial injury, identity compromise, contract disputes, or legal damages to any third party or governmental entity; or
• Your violation of any statutory law, penal code, or governmental regulation (including provisions prohibiting document forgery, bank fraud, tax evasion, and credential counterfeiting under 18 U.S.C. §§ 1001, 1028, 1344, 26 U.S.C. § 7206, and Sections 336/338 of the Bharatiya Nyaya Sanhita, 2023).

This defense and indemnification obligation will survive the termination, expiration, or cessation of your use of the website.

7. Disclaimer of Warranties

The site, services, tools, and content are provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, Edit Scanned PDF disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, security, accuracy, and uninterrupted operation.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Edit Scanned PDF, its creators, operators, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages—including without limitation damages for loss of profits, goodwill, revenue, data, business interruption, or other intangible losses—arising out of or relating to:

• Unauthorized access to, alteration of, or misuse of your transmissions or documents by third parties; or
• Any conduct, statement, or action of any third party using the site.

9. DMCA & Intellectual Property Takedown Procedure (17 U.S.C. § 512)

Edit Scanned PDF respects the intellectual property rights of others and adheres to the safe harbor provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512) and global copyright conventions. Because files are processed strictly client-side and are not hosted or retained on our servers, we generally do not host user files. However, if you believe that any material or content on our website infringes upon your copyright, you may submit a formal notification with the following details:

• A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
• Identification of the copyrighted work claimed to have been infringed;

You agree that any legal action, lawsuit, arbitration, or proceeding arising out of or relating to these Terms or the services shall be instituted exclusively in the competent civil courts located in India. You irrevocably submit to the exclusive personal jurisdiction of such courts and waive any objection to the laying of venue or claim of inconvenient forum.
